Terms of Use

1. Agreement to these terms

These Terms of Use (“Terms”) are a legal agreement between you and XTENZA TECH PRIVATE LIMITED governing your use of the Ebb application. By downloading or using Ebb, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2. Important: Ebb is not medical advice

Ebb is a wellness and self-tracking tool, not a medical device or a healthcare provider. Its predictions are statistical estimates with an explicitly stated uncertainty, and they can be wrong. Ebb does not diagnose, treat, cure, or prevent any condition, and it is not a form of contraception or a fertility/birth-control method. Do not rely on Ebb to prevent or achieve pregnancy or to make medical decisions. Always consult a qualified healthcare professional with questions about your health. Your use of Ebb is at your own discretion and risk.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use Ebb. By using the App you represent that you meet this requirement.

4. Licence

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Ebb for your own non-commercial use on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse-engineer, resell, or redistribute the App except as allowed by law.

5. Free and premium features

Ebb’s core predictions, logging, calendar, and backup are free. Certain features (such as deeper insights and the doctor-prep report) require a paid premium subscription. We may change which features are free or premium over time.

6. Subscriptions, billing, and cancellation

Auto-renewing. Premium is offered as an auto-renewing subscription (e.g. monthly or yearly). It renews automatically at the then-current price unless cancelled at least 24 hours before the end of the current period.
Billing. Payment is charged to your Apple ID account at confirmation of purchase. Your account is charged for renewal within 24 hours before the end of the current period.
Free trial. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
Manage or cancel. You manage and cancel subscriptions in your Apple ID account settings (Settings → [your name] → Subscriptions). Cancelling stops future renewals; it does not retroactively refund the current period.
Refunds. Purchases are handled by Apple and are subject to Apple’s refund policy. We do not process payments and generally cannot issue refunds directly.
Cancelling premium never deletes your data: your full history stays on your device and remains exportable.

7. Apple’s standard licence terms

The App is licensed, not sold, and is also subject to Apple’s Licensed Application End User License Agreement (EULA). You agree to comply with applicable third-party terms when using the App. Apple is not responsible for the App or its content; Apple has no obligation to provide support or handle claims relating to the App; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

8. Acceptable use

You agree not to misuse the App, interfere with its operation, attempt to circumvent purchase or security mechanisms, or use it in violation of any law.

9. Intellectual property

The App, its design, and its content (excluding your own data) are owned by XTENZA TECH PRIVATE LIMITED and protected by intellectual-property laws. These Terms grant you no rights to our trademarks or branding.

10. Disclaimer of warranties

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that predictions will be accurate or that the App will be uninterrupted or error-free.

11. Limitation of liability

To the maximum extent permitted by law, XTENZA TECH PRIVATE LIMITED will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of (or inability to use) the App, even if advised of the possibility. To the extent liability cannot be excluded, it is limited to the amount you paid us for the App in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless XTENZA TECH PRIVATE LIMITED from claims arising out of your misuse of the App or violation of these Terms, to the extent permitted by law.

13. Changes

We may update the App and these Terms. Material changes will be reflected by the “Last updated” date and, where appropriate, in-app notice. Continued use after changes means you accept them.

14. Termination

These Terms apply while you use the App. You may stop using Ebb and delete it at any time. We may suspend or end the App or specific features, with or without notice, as permitted by law.

15. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts of Coimbatore, Tamil Nadu, except where mandatory consumer-protection laws of your country of residence apply.
